Terms & Conditions
No purchase necessary. Must be 18 years or older to enter. Must be a US citizen. VOID WHERE PROHIBITED. Facebook does not endorse, sponsor, administer or associate with any Syracuse Orthopedic Specialist (SOS) contests. Facebook is not liable for any legal or unwanted consequences or results as part of participation or administration of any SOS contest. In order to enter the contest, one must post a picture to SOS’s Facebook page. For potential contestants without Internet access or a Facebook account, mail-in submissions are possible, and should be sent to the mailing address listed near the end of these terms and conditions. The video or picture should include the contest and/or contest’s friends and/or family member’s wearing apparel for their favorite sports team. The contest winner will be awarded a $50 gift card to Dick’s Sporting Goods and a portable beach volleyball set with an approximate retail value of $25. The number of eligible entries received determines the odds of winning. Participation in any SOS contest equates to participant’s acknowledgement, understanding, compliance and agreement of these contest rules, regulations, terms and conditions. By any user providing content for the purpose of any SOS contest, the user/content provider agrees that they’re granting the necessary rights and licenses to SOS to use said provided content, including contest content use in concurrent or future SOS marketing, including, but not limited to: SOS’s website and Facebook page, as well as other SOS social media marketing, SOS advertisements and in-store SOS marketing. If for whatever reason there is a major dispute/disagreement between SOS and a contestant or contestants, then SOS and the contestant(s) will try to facilitate a solution, with litigation if absolutely necessary. SOS will not collect any data from contestants that isn’t public or submitted as part of the contest. If a contestant participates via mail-in, then names and addresses may be collected. However, these names and addresses will not be collected for future SOS use, but will be collected in the sense that traditional mail typically includes a name and return address. Individuals who have questions or concerns regarding SOS’s privacy policy may contact Nicole Chidsey. If SOS changes its privacy policy, we will inform contestants via Facebook post. User content is defined as, but not limited to: photographs as part of any SOS contest or any other user/contestant/content provider creative work or content with the explicit or implied intent of contest participation.
In addition, participation qualifies as the user/contestant/content provider agreeing to a liability and publicity release if they’ve provided photos or other content that constitutes as contest participation. Contest content must not be defamatory, obscene, inappropriate or include intellectual or otherwise third-party owned property. Failure to comply with these decency standards for contest submissions will result in contest disqualification. “Inappropriate” contest content includes any contest content containing: racist, sexist or otherwise hateful or derogatory comments or symbols, animal abuse and/or pornography. SOS is not responsible for returning any contestant-provided content. No SOS contest mandates or requires participants to share any post or photo to be entered; however, contestants may do so at their own will. Contestants are not required to post anything to their personal Facebook timeline in order to enter any SOS contest. Participants are not required to tag themselves in a photo or video to vote for or enter any SOS contest; however, contestants may do so at their own will.
If a dispute or error occurs on behalf of or amongst SOS and one or more contest participants, including, but not limited to, technical failures, technical errors or typographical errors, SOS is not liable. Contest winners will be selected based on the top 10 contest entries as determined by the entries that receive the most “Likes” by Friday, August 5, 2016. The top 10 contest entries will then be entered in to the final round, and then the winner will be selected by SOS from the top 10. Contest winner(s) have until August 22, 2016 to claim their prize. The contest prize(s) must be picked up by the prize winner at the SOS PLUS Dewitt location, 5719 Widewaters Parkway, Syracuse, NY, 13214. SOS reserves the right to obtain contest winner(s)’s name(s) and the right to publicize said contest winner(s)’s name and likeness. Names and likeness will be obtained via public information on contestant Facebook profiles and/or contest submissions. Contest participation constitutes as agreement to these conditions. If prize winner forfeits the prize or fails to claim the prize, the prize will be re-awarded to another contestant. In the event that the prize is forfeited or unclaimed, the re-awarding process will be determined by SOS. Contest participation explicitly prevents SOS from liability if, for whatever reason, the contest participant is somehow harmed during participation or if the participant is somehow harmed by or from using the contest prize.
